SPOUSE OPEN WORK PERMIT
There are three types of spouse workers: the spouse of the student, the spouse of the worker, and the spouse of the applicant for reunion in the permanent resident.
Spouse work permits are open, can do any work for any employer during the validity period of the work permit, can be self-employed, can not work (legal stay), or leave Canada for another job.
Study Permit Holder
If you hold a school pass at the following school, your spouse can apply for an open work permit:
- Public higher education institutions (colleges or universities),
- Quebec’s private higher education institutions,
- Vocational training schools in Quebec,
- A private institution that can issue a diploma, and the applicant is enrolled in a project that ultimately awards a degree certificate.
- In addition to Quebec, junior college certificates or diplomas issued by private institutions in other provinces do not meet the application requirements for spouse work permits.
- If the spouse is a full-time Canadian student, you cannot apply for a spouse.
Work Permit Holder
If you hold a work permit, and
- You have NOC 0, A or B work, and the employer promises to provide at least 6 months of work, or
- You have NOC C, D work, and have submitted the corresponding provincial nominee application, or
- You have submitted an application for a Canadian experience immigrant, and apply for a work permit for your spouse while applying for a bridge work permit.
- Then your spouse can get a work permit. Please note that in most cases, if you only hold a work permit but do not work in NOC 0, A or B, your spouse will not be able to get a work permit.
Spouse of a Citizen or Permanent Resident
If the spouse of a citizen or permanent resident submits a reunion immigration within the territory and the status is legal, they can apply for an open work permit, which can also be submitted at the same time as the reunion immigration application.
Please note that only the domestic reunion meets the conditions for the spouse’s work permit, and the overseas reunion does not match. Applications that do not submit reunion immigration are more inconsistent.
If the applicant’s status has expired, you can apply for an open work permit after Approve in principle (AIP).
Validity period
The validity period of the student visa and the work permit holder’s spouse work permit is usually the same as the validity period of the student and work permit. Reunion immigrant spouse work is usually valid for 2 years.
Application method
Domestic reunion immigrant spouse work permits cannot be applied abroad or at the border. Spouses who apply for a work permit and a work permit can apply for a work permit at the border, at the border, or within the territory.
It is recommended that the spouse apply for a tourist and visa application to apply for a spouse’s work permit after entering the visa. Because there is a very high refusal rate outside the country, there is almost no refusal in the territory. The border application looks at the mood of the officials at the time. The worst case may be repatriated. It is more risky and is not recommended.
The benefit of a border application is that it can be obtained on the spot, but it usually takes 1-3 hours to travel to the US/Canada border to get a work permit.
The advantage of the online application is that the application is submitted online only, and the work permit will be sent to the applicant’s home, but it will take several weeks or even longer.
